Shots Fired Leads to Felony Arrest after Child Custody Dispute

On March 31 2025, Morganton Public Safety Officers responded to a shots fired call on Alexander Ave. Prior to officers arrival, units were advised of a possible kidnapping from 500 Alexander Ave. where a female was said to have been struck by a vehicle.

Upon further investigation, officer’s learned that Delilah Jackson and Makhi Spates who have a child in common were involved in a child custody argument.  Makhi took the child and fled from the residence while Delilah attempted to stop him.  Delillah was attempting to get their child out of the car as it was leaving, and was struck by the door of the vehicle.

The homeowner and grandparent, Leslie Davenport shot multiple rounds into the vehicle as it was leaving.  Investigator’s arrived on scene to process and collect evidence.

Morganton Public Safety Officers along with Burke County Sheriffs Deputies were able to locate the vehicle that fled driven by Makhi on Hillhaven Cir. where Makhi and their child were located in the woods.  Officers were able to locate all who were involved along with the child and transport them back to Morganton Public Safety HQ.

Burke County DSS met with investigators to make sure the child was safely placed for the night, and Burke County EMS responded to check all parties involved.

Leslie Davenport (DOB 04/21/1970) of 500 Alexander Ave. Morganton NC, 28655 was arrested for Felony Discharging a Firearm into a Moving Vehicle, and has a first appearance court date for April 3, 2025. This incident is still on going and under investigation.
