Breaking and Entering Suspect arrested while violating a domestic protection order

Early Wednesday morning, at just before 1:30 a.m., officers with the Morganton Department of Public Safety responded to a 911 call reporting a breaking and entering in progress. The caller stated that her children’s father, 34-year-old Oscar Humberto Eliza-Velasquez, had entered her home and was in the living room and that se, along with three of her children, were hiding in another room. Authorities were also informed that a Domestic Violence Protection Order was in place against Velasquez.

When officers arrived they guided the caller and her children to safety, while Velasquez, who remained in the living room, was detained by the officers.

Investigators determined Velasquez was intoxicated and was in violation of the court-ordered Domestic Violence Protection Order. Text messages revealed he had also been in contact with the caller despite the order.

Velasquez was arrested and charged with felony breaking and entering with intent to terrorize, violation of a DVPO, and domestic criminal trespass. He also had an outstanding warrant for failing to appear on a prior domestic violence charge. Velasquez is being held on a mandatory 48-hour hold, with bond to be set by a district court judge. Court dates are scheduled for April 10 and April 21, 2025.
