Caldwell County Sheriff Kevin Bean announced that an arrest has been made in connection with a suspected fatal drug overdose under North Carolina’s “Death by Distribution” law.
On April 30th, 2025, deputies responded to a suspected overdose death in the Oak Hill community of Caldwell County. After an investigation was conducted by Caldwell County Sheriff’s Office investigators, Brittany Morgan Foust, age 33 of Lenoir was identified as the individual who distributed the drugs that led to the victim’s death.
Foust has been charged with Death by Distribution, a felony under North Carolina General Statute 14-18.4. The charge carries serious penalties for individuals who unlawfully distribute controlled substances that directly result in the death of another. Foust was placed in the Caldwell County Detention Center under a $1,000,000 secured bond.
“This arrest is part of our ongoing commitment to hold those who distribute drugs accountable for the lives lost to opioids and fentanyl in our community,” said Sheriff Kevin Bean. “We will continue to pursue these cases aggressively to help hold these people accountable for distributing deadly drugs in Caldwell County.”
The investigation remains ongoing. Additional charges may be filed.
