On Friday the Burke County Sheriff’s Office announced the arrest of 37 year old Nathanial James Tate of Morganton, and 53 year old Jerry Jerome Benjamin of Morganton in connection with the shooting that happened on Saturday May 31st.
Tate was charged with Attempted First Degree Murder. Benjamin was charged with Discharging a Firearm into Occupied Property. In addition to Tate and Benjamin, an unidentified juvenile was also arrested and charged with Attempted Murder.
The incident that took place on Kathy Road in Morganton and involved multiple firearms and multiple vehicles took the life of 34 year old Gregory Rutherford. 53 year old Jerry Benjamin also sustained a gunshot wound and remains in an area hospital and stable condition. 24 year old Michael Benjamin sustained non-life-threatening injuries.
Both Tate and Benjamin were denied bond and remain in the Burke County Detention Center.
