Trespassing leads to recovery of stolen firearm

On September 30, 2025, officers with the Morganton Department of Public Safety (MDPS) responded to the area of 808 Jamestown Rd following reports from witnesses who observed an individual going through trash cans at various locations in the area. Upon arrival, officers checked the Jamestown Flea Market after reports were received the subject may also be inside that location.  Officers located Zachary Allen Hardy, 25, of Morganton, NC, trespassing inside the Jamestown Flea Market. During a search incident to arrest, officers discovered a firearm reported stolen out of Catawba County, along with additional evidence leading to multiple charges.

Mr. Hardy was taken into custody and charged with the following offenses:

  • Possession of a Stolen Firearm (Felony)
  • Carrying a Concealed Weapon (Misdemeanor)
  • Possession of Drug Paraphernalia (Misdemeanor)
  • Second Degree Trespassing (Misdemeanor)

He was transported to the Burke County Jail and placed under a 48-hour hold, or until the next available District Court Judge sets his bond.
